NailTheDeal Terms of Service

This English version is provided for convenience. In case of any discrepancy, the Polish version of the Terms is binding.

1. General provisions

1.1. These Terms set out the rules for using the NailTheDeal web and mobile application (the “Service”, “Site”, “App”), available at nailthedeal.com.

1.2. The service provider and administrator of the Site is:

1.3. The Terms are made available free of charge at nailthedeal.com in a form that allows them to be downloaded, stored and printed, in accordance with art. 8 of the Polish Act of 18 July 2002 on the provision of electronic services.

1.4. Using the Site means accepting these Terms in full.

2. Definitions

  • User — a natural person, legal person or organisational unit without legal personality using the Service, including in the course of business activity (e.g. a construction/renovation company).
  • Account — the User’s individual account in the Site, created upon registration.
  • User’s Client — the person or entity to whom the User sends a quote/offer generated in the Site.
  • Plan — a subscription variant (Free, Solo, Ekipa, Firma) with a defined set of features and limits.
  • Content — data, price lists, quotes, documents, photos, voice recordings and other materials entered by the User into the Site.
  • Consumer-entrepreneur — a natural person running a sole proprietorship who enters into a contract directly related to that business but not of a professional nature for them.

3. Nature and scope of the Service

3.1. NailTheDeal is a SaaS tool supporting small contracting companies (mainly in interior finishing and related service trades) with quoting and managing projects, teams, equipment and finances.

3.2. Core functionality includes generating quotes/estimates using AI based on a text or voice description, the User’s own price list, generating PDF documents, and online acceptance of quotes by the User’s Client.

3.3. The Site may be developed in stages — features described in the Plans may be rolled out gradually, of which the Provider informs in the Site. The Provider reserves the right to introduce new features, modify or withdraw existing ones, subject to the rules in section 10.

3.4. Content generated by the AI module is auxiliary. The User is solely responsible for verifying the correctness, completeness and legal compliance of quotes, offers and other documents before sending them to the Client.

4. Technical requirements

4.1. Using the Site requires: a device with internet access, a current version of a web browser or the NailTheDeal mobile app, and an active email address.

4.2. The Site offers an offline mode (PWA) with data synchronisation once the internet connection is restored.

5. Registration and Account

5.1. Using the full functionality of the Site requires registering an Account and providing true data.

5.2. One User (company) may create multiple employees/collaborators within the Account, subject to the limits of a given Plan. The Account owner manages permissions — in particular decides which users have access to prices, margins and financial data.

5.3. The User is obliged to keep login credentials confidential and not to share the Account with unauthorised persons.

5.4. The Provider may refuse registration or block an Account in case of providing false data, breach of the Terms, or acting to the detriment of the Site.

6. Plans and Pricing

6.1. The Site is available under the following Plans (net prices, to which VAT is added):

  • Free — free, up to 3 quotes per month, PDF documents with NailTheDeal branding.
  • Solo — PLN 79/month, for one-person crews.
  • Ekipa — PLN 179/month, for multi-person teams.
  • Firma — extended plan (price shown in the Site), for larger contracting companies.

6.2. Current prices, limits and the scope of each Plan are published at nailthedeal.com/cennik.

6.3. The Provider may offer time-limited promotions, including a discount for annual billing, on the terms described in the promotional communication in force at the time of purchase.

6.4. Changing a Plan (upgrade/downgrade) is possible at any time from the User’s Account; the difference is settled proportionally to the remaining billing period.

7. Payments

7.1. Payments for paid Plans are made in advance, in a monthly or annual cycle, via the online payment operator indicated in the Site.

7.2. VAT invoices are made available to the User electronically, according to the data provided at registration/purchase.

7.3. Failure to pay on time may result in restricted access to paid features until payment is settled, while retaining access to the User’s data under the Free Plan terms.

8. Contract duration and termination

8.1. The contract for the Free Plan is concluded for an indefinite period and may be terminated by the User at any time by deleting the Account.

8.2. The contract for a paid Plan is concluded for a billing period (month or year) and renews automatically unless the User opts out of renewal before it begins.

8.3. The Provider may terminate the contract with 30 days’ notice if it ceases providing the Service, and without notice in the event of a material breach of the Terms.

8.4. After termination, the User may export their data within 30 days.

9. Right of withdrawal

9.1. A Consumer and a Consumer-entrepreneur who concluded a distance contract has the right to withdraw from it within 14 days without giving a reason, in accordance with the Consumer Rights Act.

9.2. If the User consented to the start of the digital service before the withdrawal period ended and was informed of the loss of the right of withdrawal, that right expires once the service is fully performed. In other cases, withdrawal results in a refund of the price paid proportionally to the unused period.

10. Changes to the Terms

10.1. The Provider reserves the right to change the Terms for important reasons, including: changes in Site functionality, changes in law, or changes in payment methods.

10.2. Users with an Account are informed of changes to the Terms at least 14 days in advance by email or a notification in the Site.

10.3. Continued use of the Site after the changes take effect means accepting them.

11. User obligations

11.1. The User undertakes to use the Site in a manner compliant with the law, good practice and these Terms.

11.2. In particular, it is prohibited to: enter unlawful content; take actions that may disrupt the operation of the Site; share the Account with unauthorised persons; act to the detriment of other Users.

11.3. The User is the sole owner and administrator of their Clients’ data entered into the Site and is responsible for having an appropriate legal basis to process it.

12. Intellectual property

12.1. All rights to the Site, including the software, logo, the NailTheDeal name and the graphic layout, belong to the Provider or its licensors.

12.2. The User retains full rights to the Content they enter into the Site. The User grants the Provider a non-exclusive licence to process that Content to the extent necessary to provide the Service (including improving AI models in anonymised form).

13. Liability

13.1. The Provider makes efforts to keep the Site running continuously and correctly but does not guarantee the absence of technical interruptions resulting from maintenance, third-party provider failures, or force majeure.

13.2. The Provider is not liable for the content and correctness of quotes generated using AI — final responsibility for the content of an offer sent to a Client rests with the User.

13.3. The Provider’s liability towards a User who is not a consumer is limited to the amount of fees paid by the User for the Service in the 3 months preceding the harmful event, and the Provider is not liable for lost profits.

13.4. The provisions of point 13.3 do not limit the rights of Consumers and Consumer-entrepreneurs.

14. Complaints

14.1. Complaints about the operation of the Site can be submitted to kontakt@nailthedeal.com, with a description of the problem and the Account details.

14.2. The Provider reviews complaints within 14 days of receipt and informs the User of the outcome at the provided email address.

15. Final provisions

15.1. In matters not regulated by these Terms, Polish law applies, in particular the Civil Code, the Act on the provision of electronic services and the Consumer Rights Act.

15.2. The court competent to resolve disputes with Users who are not consumers is the court for the Provider’s registered seat. Consumers may use the ODR platform: ec.europa.eu/consumers/odr.

15.3. The rules for processing personal data are described in the Privacy Policy.

15.4. The Terms enter into force on 17 June 2026.
